Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL amending Council Regulation (EC) No 1234/2007 as regards contractual relations in the milk and milk products sector

Abstract

The proposal provides for optional written contracts to be drawn up in advance for deliveries of raw milk by a farmer to a dairy which would include the key aspects of price, the timing and volume of deliveries, and the duration of the contract.
In order to take into account the specific nature of cooperatives and not to interfere unnecessarily in current structures, cooperatives would not be required to have contracts on condition that their statutes provide for rules with the same objective.
To rebalance bargaining power, it is further proposed to allow farmers to negotiate such contract terms, including the price, collectively via producer organisations. Whilst current competition law provides for this to some extent, the possibilities are limited in the absence of shared processing facilities and there is a lack of legal certainty. The proposal provides for a legal basis in agricultural law to this end. In order not to destabilise the situation in reverse, a size limit is proposed. It does not affect dairy cooperatives, to the extent that they consist of vertical integration of farmers together with processing facilities..

Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Recast)

Abstract

The proposal puts forward various elements for reform. These are as follows:
• Abolition of the intermediate procedure for the recognition and enforcement of judgments (exequatur) with the exception of judgments in defamation cases and judgments given in collective compensatory proceedings;
• Extension of the jurisdiction rules of the Regulation to disputes involving third country defendants, including regulating the situations where the same issue is pending before a court inside and outside the EU;
• Enhancement of the effectiveness of choice of court agreements;
• Improvement of the interface between the Regulation and arbitration;
• Better coordination of proceedings before the courts of Member States;
• Improvement of access to justice for certain specific disputes; and
• Clarification of the conditions under which provisional and protective measures can circulate in the EU..

Proposal for a REGULATION (EU) No OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of … laying down specific measures in favour of agriculture in the smaller Aegean islands

Abstract

The harmonisation of Regulation (EC) No 1405/2006 with the new rules contained in the Treaty is based on classifying into delegated powers and implementing powers of the provisions adopted by the Commission pursuant to that Regulation (Regulation (EC) No 1914/2006 laying down certain detailed rules for applying Council Regulation (EC) No 1405/2006).
Following this exercise, a draft proposal recasting Regulation (EC) No 1405/2006 has been drafted. Under this draft, the Legislator reserves the right to issue decisions concerning the essential elements of a specific scheme for certain agricultural products in the smaller Aegean islands, in order to remedy the difficulties caused by their isolation, remoteness, insularity, small size, mountainous terrain and climate and their economic dependency on a small number of products.

Abstract

The objective of the proposed Regulation is to establish a legal framework for evaluating correct application of the Schengen acquis. This evaluation mechanism is designed to maintain mutual trust between Member States in their capacity to apply, effectively and
efficiently, the accompanying measures making it possible to maintain an area without internal borders.
The overall objectives of the new mechanism should be to ensure transparent, effective and consistent implementation of the Schengen acquis, while also reflecting the changes in the legal situation after integration of the Schengen acquis into the framework of the European
Union.

Abstract

The purpose of this proposal is to undertake a codification of Council
Regulation (EC) No 21/2004 of 17 December 2003 establishing a system for the identification and registration of ovine and caprine animals and amending Regulation (EC) No 1782/2003 and Directives 92/102/EEC and 64/432/EEC. The new Regulation will supersede the various acts incorporated in it; this proposal fully preserves the content of the acts being codified and hence does no more than bringing them together with only such formal amendments as are required by the codification exercise itself.

Abstract

In order to support Moldova’s economic recovery and provide a positive outlook to the people working in the wine industry in Moldova, it is proposed to increase the duty free tariff quota for wine for 2011 from 100,000 hectolitres (hl) to 150,000 hl, for 2012 from 120,000 hl to
180,000 hl, and from 2013 onwards to 240,000 hl per year.

Europe Direct Relay for Hampshire

European Law Monitor hosts the Europe Direct Relay for Hampshire, a drop-in information centre for local citizens to find out more about the EU, and its strategies and policies.

The Key Aims of European Law Monitor

Most ordinary people and organisations in Europe have little idea as to the extent they are governed by EU legislation. Nor do they have much understanding of the legislative process of the European Union, how EU Laws are made, where EU Directives and Regulations come from, or how they are implemented by EU member states.

Most importantly, they are unaware just how they can influence the legislative process to ensure their interests are protected. Our key aims are:

  • To alert consumers, NGOs, and businesses to any proposed European Union legislation that might affect their areas of interest so that they can become involved in the decision making process at an early stage.
  • To monitor the progress of new EU laws to allow users to follow their chosen acts, so that they are kept aware of their timetable for making any representations.
  • Provide help and guidance to explain the EU legislative process and the general policies of the institutions of the European Union.
  • To provide a resource to subscribers whereby interested parties can meet, exchange views, pool resources and cooperate in making representations to EU legislators.

Proposal to extend reduced VAT rate on labour intensive services to New Members

Abstract

In 1999, the EU bought in a new law which gave Member States the option of applying on an experimental basis a reduced VAT rate on labour intensive services. The idea behind this was to see whether a reduction on the VAT would help increase jobs.

Initially, this reduction was supposed to run for a three year period, until the 31st December 2002. This was then extended for another year to enable the Commission to evaluate whether or not reducing the VAT rate had had an impact on job creation.

Abstract

The purpose of this proposal is to undertake a codification of Council Regulation (EEC) No 95/93 of 18 January 1993 on common rules for the allocation of slots at Community airports. The new Regulation will supersede the various acts incorporated in it; this proposal fully preserves the content of the acts being codified and hence does no more than bring them together with only such formal amendments as are required by the codification exercise itself.

Proposal on minimum measures to control certain diseases affecting bivalve molluscs

Abstract

The Commission has decided that where legislative acts, such as the Directives relating to the control of certain diseases affecting bivalve molluscs, have been amended more than ten times, or where the laws relating to this subject are scattered over several different Directives or Regulations, they should be codified into one legal instrument, so that people do not have to spend hours cross referencing legal documents to try and find out what law applies.

The Commission has decided to codify the Directive relating to the control of certain diseases affecting bivalve molluscs. The proposal should not change the content of any of the acts being codified. The sole purpose of the above proposal is to bring together the different acts into one instrument with only such formal amendments as are required by the codification exercise itself.
As this proposal should not have anything new in it, NO EXECUTIVE SUMMARY HAS BEEN PREPARED.

Any organisations affected by these Regulations are advised to check the text of the proposal to assure themselves that it is indeed purely a tidying up exercise and that no new effects have inadvertently been introduced based on their understanding of the current law as it applies to them.

Proposal for a REGULATION (EU) No …/… OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of amending Council Regulation (EC) No 2187/2005 as regards the prohibition of highgrading and restrictions on fishing for flounder and turbot in the Baltic Sea, the Belts and the Sound.

Abstract

Council Regulation (EC) No 2187/2005 sets specific technical measures for the conservation of fishery resources in the Baltic Sea, the Belts and the Sound. This Regulation provides specific provisions relating to size and type of all components of fishing gears, including mesh sizes, among other measures.

Council Regulation (EC) No 1226/2009 fixing the fishing opportunities and associated conditions for certain fish stocks and groups of fish stocks applicable in the Baltic Sea for 2010 has provisions related to technical measures, namely article 7 on the prohibition of highgrading and in Annex III on the restrictions on fishing for flounder and turbot.

In light of the Lisbon Treaty, amending Council Regulation (EC) No 2187/2005 is therefore needed solely to move the provisions regarding technical measures out of the regulatory framework establishing annual fishing opportunities.

Abstract

The Regulation on Credit Rating Agencies is to be revised in order to introduce centralised oversight of credit rating agencies operating in the EU. According to the proposal, the European Securities and Markets Authority is to assume general competence in matters relating to the registration and on-going supervision of registered credit rating agencies as well as matters related to ratings issued by rating agencies established in third countries that operate in the EU under the certification or endorsement regimes.

Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL OF THE EUROPEAN UNION amending Regulation (EC) No 539/2001 listing the third countries whose nationals must be in possession of visas when crossing the external borders of Member States and those whose nationals are exempt from that requirement

Abstract

In proposing this amendment to Regulation (EC) No 539/20011 as last amended by Regulation (EC) No 1244/20092, the Commission is pursuing the objective of adjusting the annexes to the Regulation, taking into consideration the progress made in the visa liberalisation dialogues with Albania and Bosnia and Herzegovina during the last seven months and transferring these two countries from Annex I (the list of third countries whose nationals must be in possession of visas when crossing the external borders of Member States) to the Annex II (the list of those third countries whose nationals are exempt from that requirement) of the Regulation; this transfer is in line with the political commitment taken by the European Union on the liberalisation of the short-stay visa requirement for all Western Balkan citizens as part of the Thessaloniki agenda.

Abstract

Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on freedom of movement for workers within the Union (Codification)

Abstract

The purpose of this proposal is to undertake a codification of Council Regulation (EEC) No 1612/68 of 15 October 1968 on freedom of movement for workers within the Community. The new Regulation will supersede the various acts incorporated in it; this proposal fully preserves the content of the acts being codified and hence does no more than bring them together with only such formal amendments as are required by the codification exercise itself.

COM 2010 145 Proposal amending existing measures on the implementation of the Common Fisheries policy and the Law of the Sea

Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL amending Council Regulation (EC) No 861/2006 of 22 May 2006 establishing Community financial measures for the implementation of the common fisheries policy and in the area of the Law of the Sea

Abstract

The proposed amendments to Council Regulation (EC) No 861/2006 of 22 May 2006 establishing Community financial measures for the implementation of the Common Fisheries Policy and in the area of the Law of the Sea1 are intended to ensure coherence between the Regulation and other elements of the relevant legislative framework. In some cases, experience has demonstrated the need to ensure that the provisions of the Regulation are slightly adapted to better fit the needs. It is also proposed to clarify when necessary the scope of the measures financed and to improve the drafting of some articles.
This revision does not entail any fundamental changes to Council Regulation (EC) No 861/2006: the objectives, the type of measures financed, the architecture and the financial envelope are in principle not affected.

Proposal for a REGULATION (EU) OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL amending Council Regulation (EC) No 732/2008 applying a scheme of generalised tariff preferences for the period from 1 January 2009 to 31 December 2011

Abstract

The aim of this proposal is to amend only those elements of Regulation (EC) No 732/2008 which are necessary for the extension of its validity to 31 December 2013. As it currently stands, Regulation 732/2008 is due to expire on the 31 December 2011, and an extension is required in order to give the European Commission the time to draft a replacement regulation.
