Thursday, May 10th, 2012This instrument amends the Environmental Offences (Fixed Penalties) (Miscellaneous Provisions) Regulations 2007 (S.I. 2007/175). Regulation 2(2) alters the prescribed range for a fixed penalty capable of being specified by a waste collection authority under section 47ZB(2)(a) of the Environmental Protection Act 1990 (c. 43), in relation to an offence under section 46 of that Act, changing it from not less than £75 and not more than £110 to not less than £60 and not more than £80.

The Environmental Protection Act 1990 (Amendment of Fixed Penalty Amount) (England) Order 2012
Thursday, May 10th, 2012This instrument amends section 47ZB(2)(b) of the Environmental Protection Act 1990 (c. 43) to reduce the amount payable for a fixed penalty given under section 47ZA from £100 to £60 in the case of a fixed penalty relating to the alleged commission in England of an offence under section 46 (receptacles for household waste) (article 2). In any other case the amount remains at £100.

The Control of Dogs (Designation of the Common Council of the City of London as a Secondary Authority) Order 2012
Thursday, May 10th, 2012This order designates the Common Council of the City of London as a secondary authority for the purposes of Chapter 1 of Part 6 of the Clean Neighbourhoods and Environment Act 2005 (2005 c. 16) in respect of the areas listed in article 2. Under section 55(1) of that Act a secondary authority may make an order providing for offences relating to dogs in respect of any area for which it is designated a secondary authority.

Wednesday, May 9th, 2012This Order is made under sections 150(5) and 156(2) of the Welsh Language (Wales) Measure 2011. It commences provisions of the Measure that relate to the disclosure of information obtained by the Welsh Language Commissioner in the exercise of the Commissioner’s functions and provisions that relate to consultation with the Advisory Panel to the Commissioner. In addition, the Order commences a definition of the meaning of “compliance notice” for the purposes of those parts of the Measure that relate to Welsh language standards.

The Education (Pupil Referral Units) (Application of Enactments) (England) (Amendment) Regulations 2012
Tuesday, May 8th, 2012Section 19 of the Education Act 1996 requires local authorities to make arrangements for the provision of suitable education at school or otherwise than at school for those children of compulsory school age who, by reason of illness, exclusion from school or otherwise may not for any period receive suitable education unless such arrangements are made for them. Any school established and maintained by a local authority which is specially organised to provide education for such children is known as a pupil referral unit (section 19 (2B) of the Education Act 1996). Schedule 1 to that Act provides that enactments which apply to maintained schools can be applied with or without modification, to pupil referral units by regulations.

Local Government Pension Scheme (Amendment) Regulations (Northern Ireland) 2012
Tuesday, May 8th, 2012These Regulations contain amendments to the Local Government Pension Scheme (Benefits, Membership and Contributions) Regulations (Northern Ireland) 2009 (the Benefits Regulations) and the Local Government Pension Scheme (Administration) Regulations (NI) 2009 (the Administration Regulations) which came into operation on 1st April 2009. The Benefits Regulations and Administration Regulations form part of the regulatory framework governing the Local Government Pension Scheme in Northern Ireland (the Scheme).

The Police (Complaints and Misconduct) Regulations 2012
Tuesday, May 8th, 2012These Regulations consolidate the Police (Complaints and Misconduct) Regulations 2004 (“the 2004 Regulations”) and the various Regulations that have amended the 2004 Regulations. They also make modifications to the provisions of the 2004 Regulations in order to reflect amendments made to the Police Reform Act 2002 (“the 2002 Act”) by the Police Reform and Social Responsibility Act 2011 (“the 2011 Act”). They further modify the provisions of the 2004 Regulations in order to make improvements to the efficiency and effectiveness of the police complaints system.

The Offender Management Act 2007 (Establishment of Probation Trusts) (Amendment) Order 2012
Friday, May 4th, 2012This Order amends the Offender Management Act 2007 (Establishment of Probation Trusts) Order 2010 by inserting a new article 3A. New article 3A designates Wales Probation Trust as a “Welsh probation trust”. The amendment will enable the Auditor General for Wales to examine the accounts of the Wales Probation Trust in accordance with paragraph 13 of Schedule 1 to the Offender Management Act 2007.

Friday, May 4th, 2012These Regulations make provision for circumstances where a person has not entered into an apprenticeship agreement but is working under alternative working arrangements, by specifying the alternative English completion conditions which will entitle them to receive an apprenticeship certificate. They apply in cases where a person works in certain specified occupations as a self-employed person or otherwise than for reward (regulation 3 and Schedule 1); where a person has been dismissed by reason of redundancy, so that that person can complete the apprenticeship within 6 months of the date of the redundancy (regulation 4); and where an athlete has completed an elite sports framework in respect of a specified sport with a view to participating in the Olympic, Winter Olympic, Paralympic or Commonwealth Games (regulation 5 and Schedule 2).

The Sixth Form College Corporations (Publication of Proposals) (England) Regulations 2012
Friday, May 4th, 2012Section 33C of the Further and Higher Education Act 1992 (“the Act”) gives the Secretary of State power to establish, by order, a sixth form college corporation. Before the Secretary of State may make such an order, the proposer must publish proposals in accordance with requirements set out in section 33C(3). The proposer must also consider any representations about the proposal within the prescribed period.

The Carriage of Explosives (Amendment) Regulations (Northern Ireland) 2012
Friday, May 4th, 2012These Regulations make fairly minor amendments to The Carriage of Explosives Regulations (Northern Ireland) 2010 (“the 2010 Regulations (1)”) as a result of Directive 2010/35/EU of the European Parliament and of the Council of 16 June 2010 on transportable pressure equipment and repealing Council Directives 76/767/EEC, 84/525/EEC, 84/526/EEC, 84/527/EEC and 1999/36/EC (OJ L165, 30.6.2010, p.1). These Regulations also include a provision prohibiting the carriage of explosives unless they have been classified by an appropriate authority.
